Introduction

FSSAI License ensures the security of food products and is issued by the food safety authority in India. All the manufacturers, traders, restaurants, shop keepers, importers and exporters, etc. who are into food business and whose Annual Turnover is more than Rs. 20 lakh are required to obtain the FSSAI License. What is FSSAI License?

FSSAI License is a License for Food Business Operators (FBO) for running their business in India. A 14-digit License number is issued to food business operators (FBO) in compliance with the rules and regulations of the FSS act 2006. FSSAI License is a certificate for FBO that food which they are selling is free from degradation, having quality standards and is safe for human consumption. License number should be printed on the food products along with the FSSAI Logo.

 

How many types of Licenses are issued by FSSAI?

There are 3 types of licenses issuedby FSSAI and every Food Business Operator (FBO) must obtain according to their business yearly turnover.

    • Basic FSSAI Registration
    • State FSSAI License
    • Central FSSAI License

 

1) Basic FSSAI Registration

    • Basic license is issued by the State Government and is given to Petty manufacturers, retailers, small manufacturers, storage units, transporters, marketers, distributors, etc.
    • The business must have annual turnover up to 12 lakh.
    • The license is issued for a period of 5 years and a minimum of 1 year.

2) State FSSAI License

    • State license is for SMEs like transports, storage houses, transported, distributors, marketers, etc.
    • This license is issued by the State Government.
    • The business must have its operations in only one state.
    • The business must have an annual turnover from 12 lakh to Rs 20 Crore.
    • The license is issued for a period of 5 years and a minimum of 1 year.

3) Central FSSAI License-

    • Central License is for business operating as importers in the food business or export-oriented business, large manufacturers, operators in the Central Government Agencies, ports or airports, e commerce etc.
    • This license is issued by the Central Government.
    • Businesses operating from different states needs to have a license for the head office.
    • This license is for the FBOs having an annual turnover more than 20 crore.
    • The license is issued for a period of 5 years and at least  for 1 year.

 

What are the procedures for obtaining FSSAI License?

FSSAI License can be obtained directly from the government portal. But the process is long and requires 45-60 days to get completed. Here is the.FSSAI License procedure-

What documents are required for FSSAI License?

The FSSAI license is mandatory for the FBO except the small-sized organizations. FSSAI License is mainly categorized into two sections-

    • Central FSSAI License
    • State FSSAI License.

It depends upon the volume of the business for both the large scale or medium scale businesses.

Central FSSAI License

    • Authorized and completed Form B.
    • Proprietor, Partners or Directors list along with the details as in photocopy of ID proof, Address and contact information.
    • List of Machinery & equipment based on installed capacity and number
    • Manufacturing list of food category.
    • Address proof, name of the concerned person nominated by the manufacturer.
    • Director General Of Foreign Trade (DGFT) certified Import Export code Documents.
    • Certification from the Ministry of Tourism.
    • Proof of premises.
    • Affidavit of Ownership or Partnership deed or COI.
    • Manufacturer’s copy of License and NOC
    • Certification or plan of the management system related to Food safety.
    • NOC certified by the Local body or Municipality.
    • Proof of transportation & annual turnover documents.
    • FSSAI Nomination Form IX.
    • Declaration Form

 

Documents required for State FSSAI License

    • Authorized and completed Form B.
    • Proprietor, Partners or Directors list along with the details as in photocopy of ID proof, Address and contact information.
    • List of Machinery & equipment based on installed capacity and number
    • Manufacturing list of food category.
    • Address proof, name of the concerned person nominated by the manufacturer.
    • Copy of Certificate acquired under the Multistate Coop Act 2002 or Coop Act 1861.
    • Proof of premises
    • Affidavit of Ownership or Partnership deed or COI.
    • Copy of Manufacturer’s License and NOC
    • Certification or plan of the management system related to Food safety

 

What is an improvement notice and by whom it is issued?

Under the Rules & Regulations of FSS Act, 2006, if any FBO shrinks to comply with the Regulations of the food and safety department. A Designated officer (DO) can issue an Improvement Notice to the respective FBO.

 

What is the validity time of the FSSAI License?

FSSAI license is valid for 1 to 5 years. According to the FSSAI rules, the Food Business Operator is required to appeal for the renewal of the license in 30 days before it expires. If any FSSAI renewal application filed exceed the expiry date, then the FBO is required to pay a late fee of Rs.100 per day for each day of delay.

Thus, it is essential for all FBOs to track and assure that their FSSAI license is valid at every point of time.
